1. Acceptance of Terms
Welcome to Baska, operated by PT Trendcas Global Digital ("we," "our," or "us"). By downloading, installing, accessing, or using the Baska application (the "Application"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not download, install, or use the Application.
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without giving effect to any principles of conflicts of law.
2. Eligibility
You must be at least 16 years of age (or the minimum legal age of consent in your jurisdiction) to use Baska. By using the Application, you represent and warrant that you have full legal capacity to enter into a binding agreement. If you are accepting these Terms on behalf of a company or entity, you warrant that you possess full legal authority to bind such entity to these Terms.
3. License Grant
Subject to your compliance with these Terms, PT Trendcas Global Digital grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use Baska on compatible devices that you own or control, strictly for your personal or internal business purposes.
4. Distribution & In-App Purchases (App Store & Play Store)
Baska is distributed and monetized exclusively through official mobile and desktop application stores:
- Apple App Store (iOS / iPadOS / macOS): Purchases, auto-renewable subscriptions, and in-app upgrades are processed through Apple Media Services using your Apple ID account. All transactions are governed by Apple's Licensed Application End User License Agreement and Terms of Service.
- Google Play Store (Android): Purchases and subscriptions are processed through Google Play Billing using your Google account. Transactions are subject to Google Play Terms of Service.
No Direct Payment Processing: PT Trendcas Global Digital does not process web-based payment cards directly for Baska. All payment processing, tax calculation, and billing handling are conducted by Apple Inc. and Google LLC as store distribution operators.
Subcription fees will automatically renew at the end of each subscription period unless you cancel your subscription at least 24 hours prior to the current period expiration through your Apple ID or Google Play account settings.
5. Refund Policy
All in-app purchases and subscriptions are non-refundable except as specified in our official Refund Policy or required under applicable consumer protection law. Refund requests for purchases made via Apple App Store must be submitted directly to Apple. Refund requests for purchases made via Google Play Store are handled according to our Refund Policy guidelines.
6. User Obligations & Restrictions
When using Baska, you expressly agree not to:
- Decompile, reverse-engineer, disassemble, modify, or attempt to derive the source code of the Application.
- Bypass, disable, or tamper with security or subscription verification mechanisms built into Baska.
- Use Baska for any unlawful, fraudulent, malicious, or unauthorized activities under applicable laws.
- Distribute, sell, lease, sublicense, or share your account or subscription credentials with unauthorized third parties.
- Upload, transmit, or store content that violates third-party intellectual property, privacy, or legal rights.
7. Data Protection & Privacy
Your privacy is important to us. Your access and use of Baska are subject to our Privacy Policy, which details how we collect, use, and protect your information under GDPR and the Indonesian Personal Data Protection Law (UU PDP). By using Baska, you consent to our data practices as outlined in the Privacy Policy.
8. Intellectual Property Rights
The Application, including its source code, interface designs, logos, graphics, icons, software architecture, trademarks, and branding ("Baska Content"), is the exclusive property of PT Trendcas Global Digital. Nothing in these Terms grants you any ownership rights or intellectual property rights except for the limited license explicitly described in Section 3.
9. Disclaimer of Warranties
Baska is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. PT Trendcas Global Digital disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title.
We do not warrant that the Application will be uninterrupted, error-free, completely secure, or compatible with all hardware configurations.
10. Limitation of Liability
To the maximum extent permitted by applicable law, PT Trendcas Global Digital, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss, business interruption, or system failure resulting from your use of or inability to use Baska.
In no event shall our total aggregate liability for any claims arising out of or related to these Terms or the Application exceed the total amount paid by you for Baska during the three (3) months immediately preceding the event giving rise to the claim.
11. Modifications & Updates
We reserve the right to update or modify Baska and these Terms at any time. Material changes will be published on this page with an updated revision date. Continued use of Baska following the posting of revised Terms constitutes your acceptance of the changes.
12. Termination
We may suspend or terminate your right to use Baska immediately, without prior notice, if you breach any provision of these Terms. Upon termination, your right to use Baska will cease, and you must delete all copies of the Application installed on your devices.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed under the laws of the Republic of Indonesia. Any legal disputes arising out of or in connection with these Terms or Baska shall be submitted to the exclusive jurisdiction of the competent courts in Jakarta, Indonesia.
